1. Introduction
These terms apply to services supplied by PaintSpray.co.uk. Accepting a quotation, paying a deposit, instructing us to proceed or delivering goods for work indicates acceptance of the quotation and these terms.
2. Services
Services may include preparation, priming, spray painting, clear coating, staining, fire-rated coating systems, specialist finishes, controlled curing, collection, delivery and related workshop work described in the quotation.
3. Quotations
3.1 Validity
Quotations are valid for the period stated. If no period is shown, they may be revised if material, labour, transport or project information changes.
3.2 Additional work
Quotations rely on information, photographs, drawings and samples supplied before work begins. Hidden damage, contamination, unsuitable previous coatings, inaccurate quantities or additional preparation may result in a revised price.
4. Customer responsibilities
The customer must provide accurate dimensions, quantities, substrate details, colour and sheen requirements, access information and any fire-performance or technical specification. Items must be structurally sound and suitable for the requested process.
5. Colour matching and finishes
5.1 Colour matching
Reasonable care is taken to match recognised references or supplied samples. Perceived colour varies with substrate, sheen, lighting, surrounding colours, ageing and production batch.
5.2 Sample approval
Where exact appearance is important, the customer should approve a physical sample before full production. Approval confirms acceptance of the appearance under the conditions in which the sample was viewed.
5.3 Natural variations
Timber grain, veneers, porous edges, repairs and mixed substrates can produce natural variations that remain visible through a finish.
6. Existing damage and surface conditions
We are not responsible for failure caused by hidden moisture, movement, contamination, unstable previous coatings, silicone, wax, oil, structural defects or unsuitable substrate preparation completed by others.
7. Collection and delivery
7.1 Collection service
Collection and delivery are provided only where agreed and may be charged separately. The customer must provide safe access and accurate information about item dimensions, weight and handling.
7.2 Delivery times
Delivery and completion dates are estimates unless expressly confirmed as fixed in writing. We are not liable for reasonable delays caused by materials, curing, access, transport, variations or events outside our control.
7.3 Inspection on delivery
Items should be inspected promptly. Visible transport damage or shortage should be reported as soon as possible and supported by photographs.
8. Project timelines
Production windows begin once required information, approvals, goods and payment have been received. Changes after approval may affect price and completion date.
9. Access and delays
Where work is completed on site, the customer must provide suitable access, power, lighting, ventilation, protection arrangements and a safe working environment. Abortive visits and delays outside our control may be charged.
10. Payment terms
10.1 Payment
Deposits, stage payments or payment before collection may be required as stated in the quotation. Unless credit terms are agreed in writing, cleared payment is due before finished goods are released.
10.2 Commercial customers
Approved credit accounts are subject to the agreed payment period and credit limit.
10.3 Late payments
We may pause work, withhold goods, withdraw credit terms and recover reasonable collection costs where payment is overdue.
11. Ownership of goods
Ownership of coatings and supplied materials incorporated into the work does not pass until all sums due have been paid. We may exercise lawful rights over goods in our possession for unpaid charges.
12. Warranty
12.1 Workmanship warranty
Concerns about workmanship will be assessed and, where accepted, the appropriate remedy may be repair, refinishing or another reasonable solution.
12.2 Exclusions
Warranty does not cover impact, abrasion, misuse, excessive heat or moisture, cleaning chemicals, movement, substrate failure, installation damage, third-party alterations, fair wear and tear or conditions outside the intended use.
12.3 Reporting issues
Issues should be reported promptly with photographs and project details. The item must be made available for inspection before third-party repair is arranged.
13. Limitation of liability
Nothing excludes liability that cannot lawfully be excluded. Subject to that, liability is limited to reasonably foreseeable direct loss and will not exceed the amount paid for the affected service, except where law requires otherwise.
14. Photographs and marketing
We may photograph workshop processes and finished work for quality records and marketing, provided confidential project or personal information is not intentionally disclosed. Tell us in writing before work begins if photography is prohibited.
15. Force majeure
We are not responsible for delay or failure caused by events beyond reasonable control, including supply interruption, utility failure, transport disruption, severe weather, fire, flood, industrial action or government restriction.
16. Consumer rights
Nothing in these terms removes statutory rights available to consumers under applicable UK law.
17. Complaints
Complaints should be sent to info@paintspray.co.uk with the quotation or invoice reference and supporting information. We will review the matter and respond within a reasonable period.
18. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction subject to applicable consumer rights.
